In order to prepare your will, you will want to answer the following questions.
- Are there any children under 18?
- At what age after 18 do the children receive their inheritance? (for example 21, 25, 30)
- Do you wish for the children to receive their inheritance early for education or health reasons?
- Do you wish to give anything specific to anyone (for example $5,000)?
- Are you requesting a guardian for any children?
- Who is the Executor(rix)?
- What happens if they die before you?
- Do you wish to exclude anyone from the will (you can't exclude a husband or wife, but you can exclude children)?
- If you wish to give anything to a charity, please note that we must notify the state that there is a gift to a charity.
- Do you wish to include your children's in laws in the will in the event that your children die before you?
- If one of your children were to die before you, do you want their share to go to the surviving children or to your grandchild?
- Are you going to provide for children of a prior marriage and/or a spouse of a prior marriage?
- Do you have any sort of written agreement to provide for anyone?
